The essence of the matter is described in the register of court decisions (case no. 3/554/1455/2021 dated 20.08.2021, case no. 554/5643/21). According to the materials, on August 16, 2020, the Oktyabrsky District Court found Sergey Klimov guilty of driving under the influence of alcohol. On December 21, the situation repeated itself down to the smallest detail. In both cases, the court ruled a fine of 10,200 UAH and revocation of the driver's license for one year.
Nevertheless, on June 5, 2021, the driver was again stopped while intoxicated. He showed obvious symptoms of intoxication (smell of alcohol from the mouth, problems with coordination and speech, noticeable tremor of fingers, unnatural change in skin color), but he refused a medical examination, and this was recorded in the presence of two witnesses.
Since Klimov did not draw conclusions from previous punishments and continued to violate the law, even being deprived of his license, and his behavior overall indicated a significant threat to others, the court decided that to stop such activities, the car (Mitsubishi Lancer) should be confiscated in favor of the state.
Additionally, the court imposed a fine of 51,000 UAH and a ban on driving vehicles for a period of 10 years.
