In Ukraine, it is possible to file a traffic accident without calling the police only if all the conditions of the European Accident Report are met simultaneously. The drivers' consent alone is not enough: the consequences of the accident, insurance and the condition of its participants matter. This is reported by the Motor (Transport) Insurance Bureau of Ukraine.

European Accident Report in a traffic accident: five reasons to call the police

Self-filing of an accident is not possible in the following cases:

  1. There are injured or deceased persons. The European Accident Report is permitted only in the absence of harm to human life and health.

  2. The circumstances of the accident do not meet the requirements. More than two vehicles are involved in the incident, there was no collision between them, or property other than vehicles was damaged.

  3. There is no valid insurance. To use the European Accident Report, both vehicles must have valid compulsory motor third party liability insurance (CMTPL) or a corresponding foreign Green Card certificate.

  4. The drivers do not agree on the circumstances. If the participants describe the course of the accident differently, it cannot be filed without the police.

  5. There are signs of intoxication. This refers to alcohol, drug or other intoxication, as well as the influence of medications that reduce attention and reaction speed.

All requirements apply simultaneously. For example, the absence of injured persons and valid policies do not allow use of the European Accident Report if a fence was also damaged during the collision.

“An agreement between the drivers is only one of the conditions. If at least one requirement is not met, the traffic accident must be filed with the participation of the police,” reminds author Oleksii Astapov.

The list of restrictions is based on the official conditions of the MTIBU.
