As reported by "I and the Law", the accident occurred in June 2020. The accused was riding an electric scooter Xiaomi Mi Electric Scooter M365 on the sidewalk and hit a pedestrian. The victim sustained moderate bodily injuries.
During the trial, the court recognized the electric scooter as a device intended for transporting people and/or cargo, as well as equipment and mechanisms installed on it.
According to clause 11.13 of the Ukrainian Traffic Rules, the movement of vehicles on sidewalks and pedestrian paths is prohibited. Accordingly, the court found the accused guilty under Article 291 of the Criminal Code and sentenced him to 1 year of imprisonment, but released him from serving the term with a probation period.
The accused must also pay 102 thousand hryvnias for material damage, 23 thousand hryvnias for moral damage, and 2000 hryvnias in compensation for legal costs.
