The Verkhovna Rada adopted in the second reading the draft law No. 5364, concerning the reform of the parking system in Ukraine. 237 people's deputies voted for this decision.
The document implies adjustments to a number of legislative acts, including the Code of Administrative Offenses, laws on local self-government, road traffic, the National Police, and insurance.
As stated in the explanatory note, the goal of the initiative is to create a parking system comfortable for drivers, as well as to make punishment for violations of parking and stopping rules inevitable.
One of the key provisions is the introduction of a mechanism for automatic recording of violations using photo and video cameras, which should ensure the inevitability of responsibility.
In addition, it is proposed to bring the owner of the vehicle to administrative responsibility if the violation is recorded automatically, without establishing the identity of the driver.
In particular, for non-payment for the use of paid parking, a fine is provided in an amount exceeding the cost of one hour of such service by twenty times.
A resolution on imposing a fine for a violation recorded by an automatic system may be issued without the presence of the violator himself.
In this case, the document will be sent by registered mail to the address specified during vehicle registration. It is considered that the resolution is delivered three days after sending.
Even if the letter is returned to the sender, it will still be considered delivered — such a norm is introduced so that drivers cannot avoid punishment.
At the same time, car owners will have the opportunity to check information about fines via the Internet.
Controlling bodies will be obliged to leave a copy of the resolution or notification on the windshield of the car if the violation is recorded by cameras.
Separate innovations concern cars with foreign registration. For violations recorded automatically, the person who brought such a car into the territory of Ukraine will be responsible.
Foreign drivers will be served resolutions on fines by the State Border Guard Service.
Parking inspectors will be prohibited from accepting cash as payment for parking services or fines.
Amendments to the laws on road traffic and local self-government empower the Ministry of Internal Affairs to maintain the Register of Administrative Offenses in the field of road safety, provide access to its data, and bring violators to responsibility.
Requirements for the arrangement and operation of parking areas are also established.
The law will come into force 180 days after official publication.
