In particular, this implies driving into the oncoming lane, caused by the need to go around a pothole, rut, etc. The explanatory note to draft law No. 3130 states the following:
"Persons specified in the first part of this article may be brought to administrative responsibility for offenses in the field of road safety, recorded by special technical means operating in automatic mode, with photo and film shooting, video recording functions, only on a highway, street, or at a railway crossing that comply with the state standards of Ukraine," – the text of the draft law states.
That is, if the draft law is approved and implemented, drivers will not be brought to administrative responsibility for offenses that were committed forcibly, due to the non-compliance of the condition of highways with the requirements of state standards. To resolve this issue, it is proposed to amend Articles 14-1, 279-3, 280, and 283 of the Code of Administrative Offenses.
