Let me explain, as a non-lawyer. Regarding payment terms — check your insurance contract, it usually specifies the month. If parts are available, the service station can repair the car for up to 45 days. But this is not a warranty case, so ideally, but in practice — as luck would have it. If the car is leased to an enterprise, and you are a private entrepreneur and cannot work without the car (and can prove it in court), or you are disabled and so on — then collect all documents and present them for payment to the culprit of the incident. But if none of that applies and you can't prove it in court — buy sturdy, quality shoes. Good luck!

In my opinion, the key here is to choose a reliable insurer. If you run into a dubious company, you'll only wear out your nerves and waste time on unnecessary visits.
