TRAFFIC POLICE WILL NOT check technical condition on the roads!

According to lawyer Vadim Volodarsky, the new law does not grant such a right. Nor did the previous one, for that matter. Article 35 of the Law "On Road Traffic" for a long time provided for only one form of technical condition inspection — state technical inspection. According to Article 19 of the Constitution of Ukraine, officials are not entitled to perform actions not directly provided for by law. Therefore, "technical inspection on the road" has long been outside the legal framework.

Actions of the State Automobile Inspection and resolutions on administrative offenses issued as a result of such inspections can be appealed, including in court. And there is simply no legal mechanism that would allow the use of equipment purchased for these purposes.
